EU Regulation Supplementing Directive 2014/53/EU Becomes Effective

Commission Delegated Regulation (EU) 2023/2444 of 20 July 2023, which amends Delegated Regulation (EU) 2022/30 supplementing Directive 2014/53/EU of the European Parliament and of the Council with regard to the application of the essential requirements, became effective in 2025.

As a result, the essential requirements of Directive 2014/53/EU are now mandatory for certain categories of radio equipment when such equipment can process personal data under Regulation (EU) 2016/679, or traffic data or location data under Directive 2002/58/EC.

The requirements apply to the following radio equipment:

  • Internet-connected radio equipment
  • Radio equipment designed or intended exclusively for childcare
  • Radio toys covered by Directive 2009/48/EC
  • Radio equipment that can be worn on the human body or clothing

With these measures, the European Parliament and the Council aim to reduce network security risks and protect personal data and user privacy, particularly in the context of connected and IoT devices.

In support of the updated requirements, a new series of standards for internet-connected radio equipment has been developed:

  • EN 18031-1:2024: Defines common security requirements for internet-connected radio equipment;
  • EN 18031-2:2024: Specifies technical requirements for radio equipment that processes personal, traffic or location data, including internet-connected, childcare, toy, and wearable radio equipment;
  • EN 18031-3:2024: Outlines cybersecurity requirements for radio equipment that processes virtual money or monetary value and is capable of internet communication;

GMA Consult Group kindly reminds manufactures of radio equipment that the list of harmonised standards supporting of Directive 2014/53/EU has been updated. Starting from December 11, 2025 the following versions of standards apply:

  • EN 300 220-2 V3.3.1 — Short-Range Devices (SRD) operating in the frequency range 25 MHz to 1 000 MHz with power levels up to 500 mW e.r.p.; Part 2: Harmonised Standard for access to radio spectrum for non specific radio equipment;
  • EN 302 480 V3.1.1 — Mobile Communication On Board Aircraft (MCOBA) systems. Harmonised standard for access to radio spectrum;
  • EN 302 729-1 V3.1.1 — Short-Range Devices (SRD) using Ultra Wide Band technology (UWB); Harmonised standard for access to radio spectrum; Part 1: Level Probing Radar (LPR) equipment operating in the frequency ranges 6 GHz to 8,5 GHz, 24,05 GHz to 26,5 GHz, 57 GHz to 64 GHz, 75 GHz to 85 GHz for strictly vertical downward installation;
  • EN 303 659 V1.1.1 Short-Range Devices (SRD) in Data Networks; Radio equipment to be used in the frequency ranges 865 MHz to 868 MHz and 915 MHz to 919,4 MHz; Harmonised Standard for access to radio spectrum;
  • EN 305 550-6 V1.2.1 Short Range Devices (SRD) to be used in the 40 GHz to 260 GHz frequency range; Harmonised Standard for access to radio spectrum; Part 6: Specific radiodetermination applications - Tank Level Probing Radar (TLPR) and Level Probing Radar (LPR) equipment operating in the frequency ranges 116 GHz to 148,5 GHz; 167 GHz to 182 GHz and 231,5 GHz to 250 GHz.
