China Amends Cybersecurity Law: New Focus on AI and Operator Responsibility

On October 28, 2025, the Standing Committee of the National People's Congress officially adopted significant amendments to China’s Cybersecurity Law (CSL). 

The new amendments are set to take effect on January 1, 2026. The amendment introduces a framework for:

  • Safety Assessments
    Providers of AI-driven services must ensure their algorithms are transparent, fair, and do not compromise national security or public interest.
  • Data Integrity in AI Training
    New rules regulate how data is collected and used to train large language models (LLMs) and generative AI, emphasizing the "quality and legitimacy" of training datasets.

The 2026 update significantly raises the bar for all network operators in China.  There is an increased emphasis on the security of "critical network equipment" and "specialized cybersecurity products." Operators must ensure that their technical suppliers meet updated national standards.

The amendment introduces a more robust system of fines and administrative penalties for non-compliance, aimed at ensuring the law acts as a serious deterrent.

As China continues to tighten its digital borders, companies exporting "smart" or network-connected equipment must ensure their devices are compliant with the updated standards. Specifically:

  • Technical Documentation
    Updates to AI-related technical files may be required.
  • Certification Checks
    Ensure your network products remain certified under the latest list of "Critical Network Equipment."

We recommend that all clients with digital or AI-integrated products in the Chinese market conduct a comprehensive compliance audit before the January 1, 2026 deadline.
