Morocco Postpones Implementation of Its Conformity Mark

On July 29, 2019, the Moroccan Ministry of Industry, Trade, Investment and the Digital Economy announced online that it postpones implementation of rules regarding Moroccan safety conformity mark. The implementation date is delayed till December 31, 2019.

The Moroccan conformity mark was established by Law No. 24-09 named “Safety of Products and Services”. The Law sets the framework for the obligation for any importer or manufacturer to label products complying with the requirements of the law.

Under this Law the following equipment must comply with safety rules and regulatory technical requirements and bear a new mark:

  • low-voltage electrical equipment (LVD) designed for the use at a voltage rating 50-1000V for alternating current and 75-1500V for direct current

  • the electromagnetic compatibility (EMC) of equipment (does not include wireless communication equipment or telecommunications terminals)

  • toys

Manufacturers and importers have the following obligations:

  • Evaluate their products

  • Provide Declaration of Conformity in Arabic

  • Holding the Technical File within Morocco for 10 years starting from its last shipment

  • At the end of the process, affix the required marking on the product

Manufacturers and importers have a grace period to comply with the label requirements. In its announcement, The Ministry states that from August 1, 2019 products must be marked. However, the Ministry published a new announcement that labelling requirements for regulated products is extended until December 31, 2019.

From January 1, 2020, products must be marked with required Conformity mark by the manufacturers themselves. Imported products will have to comply before arriving at the Morrocan Customs for clearance.

Example of the Moroccan Conformity Mark

The Moroccan Conformity Mark should be visible and legible on the equipment or its data plate. The vertical dimension of the “C” of the mark must be greater than or equal to 6mm. If the device is too small, or in case it does not make sense to affix it to the product, it shall be affixed to the packaging and to the accompanying documents.
