Compliance to Customs Union Technical Regulations When Exporting to the EAEU

Technical Regulations were established in the EAEU for creating common and binding requirements to products and related processes within the members-states (Belarus, Russia, Kazakhstan, Kyrgyzstan and Armenia). The documents ensure the implementation of safety requirements to ​protect human life, health, and the environment. That is why, when the product is accessing the EAEU market, it should comply with the requirements of relevant EAEU technical regulations to prove its safety.

Conformity of a product with the requirements of the EAEU TRs is ensured by meeting safety requirements of the Technical Regulations, directly and/or by applying the requirements of the standards from the list of interrelated standards that are the integral part of each EAEU Technical Regulation.

Today, the number of standards in the lists to the EAEU technical regulations exceeds 11,000.

It should be mentioned that recently the Technical Regulation “On Restriction of the Use of Hazardous Substances in Electrical and Electronic Products" (EAEU TR 037/2016) was adopted in the EAEU. It will become mandatory from 2020.

This technical regulation applies to the following categories of products:

  1. Electrical apparatuses and appliances for household use

  2. Electronic computing machines and devices connected to them and their combinations

  3. Telecommunication facilities

  4. Photocopiers and other electrical office equipment

  5. Electrified tools

  6. Light sources and lighting equipment

  7. Electronic music instruments

  8. Gambling and vending machines

  9. Cach registers, ticket printers, identification card readers

  10. Cables, wires and cords to be used at a rated voltage not exceeding 500 V AC/DC except optical fibre cables

  11. Circuit breakers and protective cutout devices

  12. Fire detectors, security detectors, and their combinations

However, as every EAEU TR, EAEU TR 037/2016 also has its own exceptions.

Thus, as you can see additional requirements appeared for electrotechnical and radio electronic products with regards to RoHS. EAEU TR 037/2016 requirements will become mandatory from March 1, 2020. However, it doesn’t mean that if you put your product to the EAEU market prior to this date, you won’t need to show the compliance to this regulation after March 1, 2020. On the contrary, it doesn’t matter when you put the product to the EAEU market, starting from March 1, 2020 you should have EAEU DoC against RoHS requirements anyway.
