What You Need to Know When Importing Electrical Products to the EAEU

August 12, 2019

Electrical products must meet technical requirements of the EAEU to be placed on the market. As we have mentioned earlier, the EAEU technical regulations contain mandatory requirements for safety aspects. The requirements of the EAEU technical regulations can be met through creating the presumption of conformity with TRs by application of relevant standards.

Technical Regulations particularly relevant to electrical products are:

  • EAEU TR 004/2011 on the safety of low-voltage equipment

  • EAEU TR 020/2011 on the electromagnetic compatibility of technical means

  • EAEU TR 010/2011 on the safety of machinery and equipment

  • EAEU TR 037/2016 on the restriction of hazardous substances in electrical and electronic equipment

It should be noted that whether or not the products are subject to conformity assessment according to the technical regulation EAEU TR 004/2011, they also might be subject to other regulations, such as EAEU TR 037/2016 “On the restriction of the use of certain hazardous substances in electrical and electronic equipment”, EAEU TR 010/2011 “On safety of machinery and equipment” or EAEU TR 020/2011 “On electromagnetic compatibility of technical devices”.

In most cases, the technical regulation of the Eurasian Economic Union 037/2016 “On the restriction of the use of certain hazardous substances in electrical and electronic equipment” should be met as it contains mandatory safety requirements for certain hazardous substances in electrical and electronic devices for the protection of life, health, and the environment. It also aimed at preventing misleading actions against consumers. It sets forth the requirements for permissible concentrations of lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls, polybrominated diphenyl in the produced electrical devices.

Please, be aware that EAEU TR 037/2016 requirements become mandatory from March 1, 2020. However, it doesn’t mean that if you put your product to the EAEU market prior to this date, you don’t need to show the compliance to this regulation after March 1, 2020. On the contrary, it doesn’t matter when you put the product to the EAEU market starting from March 1, 2020 you should have EAEU DoC against RoHS requirements anyway. In case of violation, the penalty is implemented.

Note that the applicant for the conformity assessment procedure against EAEU TRs can only be a legal entity or a person that is registered in EAEU member countries.

Last but not least, some categories of electrical products have additional national requirements within EAEU members countries. At least such regulatory areas as energy efficiency or WEEE aspects should be mentioned here. Currently, within the EAEU there are no common regulations on these areas. That is why some members countries use their national regulations. For example, Belarus enforces National requirements on Energy Efficiency and Energy Labelling for a range of electrical appliances. Russia also has number of enactments on Production and Consumption Wastes.
