New Caledonia Approves EE Requirements and Restricts Import of Certain Goods

On December 26, 2018, the Congress of New Caledonia adopted Law № 2018-25 establishing Energy Efficiency requirements and banning the import of equipment containing ozone-depleting substances and incandescent or halogen bulbs.

On February 26, 2019, the Government of New Caledonia also adopted Order № 2019-447/GNC that implements foregoing Law No. 2018-25 and established specific requirements for certain goods.

The above-mentioned Law and Order entered into force on March 1, 2019.

The Regulation applies to electrical and electronic equipment, such as:

  • wine coolers, refrigerators, freezers and combination refrigerator-freezer equipment with a storage volume between 10 and 1,500 liters

  • washing machines

  • clothes dryers

  • dishwashers

  • air conditioning equipment with a rated capacity of less than or equal to 12kW

  • televisions

The Regulation sets out the following requirements to imported equipment:

1. Requirements for ozone-depleting substances contained in the product

The import of the equipment is prohibited if it contains one of the substances referred to in Regulation (EC) № 1005/2009 on substances that deplete the ozone layer.

The Regulation also sets out bn on the import of incandescent or halogen bulbs as of January 1, 2020 with the exception of bulbs for which no climate-friendly alternatives exist and which are excluded from this prohibition.

2. Requirements to comply with Energy Efficiency Standards

Any equipment imported into New Caledonia must meet the Energy Efficiency Standard mentioned in the Regulation. The conformity must be provided during Customs clearance.

3. Labeing requirements

The equipment imported from the European Union must be affixed with the EU energy label whilst equipment imported from non-EU countries must be affixed with both: a Country of Origin label and the New Caledonian Energy label.

The New Caledonian Energy Label shall be downloaded exclusively from an online computer tool available on the website of the New Caledonia Ministry of Industry, Mines and Energy (DIMENC). It should be printed in A6 format.

Example of the label (valid for April 2019):

The Energy Label of the Country of Origin should be displayed on the front side, in the upper right corner.

The New Caledonian Energy Label should be displayed alongside the energy label of the country of origin on the same side and in the same format so as to be directly visible to the user.
