New Technical Regulations on the Safety of Toys in Ukraine
Starting from September 21, 2018, a new technical regulation on the safety of toys is coming into force in Ukraine.
The TR was developed on the basis of Directive 2009/48/EC to ensure that national legislation is brought into line with the norms of the legislation of the European Union.
The Technical Regulation applies to products that developed or intended for children up to 14 years old.
There is no transitional period but all toys that approved and introduced into circulation before the date of this Resolution shall not be prohibited or restricted.
Technical Regulation does not apply to the following toys:
playground equipment intended for public use
automatic playing machines, whether coin operated or not, intended for public use
toy vehicles equipped with combustion engines
toy steam engines
slings and catapults
Technical regulation defines:
- responsibilities of business entities (manufacturers, authorized representatives of the manufacturer, importers, distributors) - essential requirements for the safety of toys - provisions regarding presumption of conformity of toys to safety requirements - issues related to the preparation of a declaration of conformity, affixing of a mark of conformity - provisions on designated conformity assessment bodies and special requirements for them - provisions on the implementation of state market supervision - special safety requirements - requirements for technical documentation - requirements for warnings (general, special warnings, and signs of caution when using certain categories of toys)
