Guide to Technical Regulations for Radio Electronic Devices in Ukraine (Part 1)

Starting from April 1, 2018, new technical regulations for radio electronic devices came in force in Ukraine. These TRs are subject to the Decision № 355 “On approval of the Technical Regulations for Radio Equipment” (UA RED TR) applied by The Cabinet of Ministers of Ukraine dated 24.05.2017.

 

The Ukrainian Technical Regulations for radio devices are equal to the Directive 2014/53/EU of the European Parliament and European Council dated 16.04.2014.

 

The following UA Technical Regulations are not applicable to the radio equipment covered by UA RED Technical Regulations:

 

  • The technical regulations for the low-voltage electric equipment approved by the Resolution №1067 of the Cabinet of Ministers of Ukraine as of December 16, 2015.

  • The technical regulations for electromagnetic compatibility of the equipment approved by the Resolution №1077 of the Cabinet of Ministers of Ukraine as of December 16, 2015 (but equipment must have an appropriate level of electromagnetic compatibility, established in the Technical Regulations for Electromagnetic Compatibility).

 

Manufacturers must inform the National Commission for the State Regulation of Communication and Informatisation (NCCIR) about the types of radio equipment, which has a low level of compliance with the requirements. This information must contain pieces of technical documentation. The NCCIR will then provide each manufacturer with the registration number for each type of such equipment. This number must be applied to the radio equipment appeared on the market from June 12, 2018.

 

Conformity assessment procedure

 

The Declaration of Conformity should be issued to the manufacturer (or his authorized representative) and the UA TR Conformity Mark should be placed to confirm the compliance with the Ukrainian Technical Regulations.

 

According to the Technical Regulations, if a manufacturer applies for compliance with the standards from the list of national standards covering the requirements of this Technical Regulations, he can apply for any of these conformity assessment procedures:

 

  • module A (internal production control)

  • modules B (type examination) and C (compliance with the type based on the internal control of products)

  • module H (compliance based on the full quality assurance)

 

If a manufacturer does not apply or partially applies for compliance with the standards from the list of national standards covering the requirements of this Technical Regulations, or when such standards are not available for this type of radio equipment, it may apply for any of such conformity assessment procedures to assess the conformity of radio equipment:

 

  • modules B (type examination) and C (compliance with the type based on the internal control of production)

  • module H (compliance based on the full quality assurance)

 

However, not all standards under these Technical Regulations are approved for today. Thus, the NCCIR will conduct a conformity assessment by module B or H. To assess the conformity of products, it is necessary to provide a complete technical file, and in some cases, the NCCIR may request samples.

 

The NCCIR confirms the assessment of products and their compliance with the requirements of frequencies and power.

 

A conformity assessment procedure according to module B (type examination) includes an examination of technical documentation and supporting documents without examining a sample (design model).

If the type of radio equipment meets the requirements of this Technical Regulations for the conformity assessment procedure according to module B, a responsible authority shall provide the manufacturer with an examination certificate.

 

After the national declaration of conformity is accepted by the manufacturer (or its local representative in Ukraine), the national conformity mark (UA TR mark) should be applied. The mark of compliance with technical regulations may not be accompanied by the identification number from the responsible conformity assessment body if conformity assessment is carried out according to the module B.

 

 

It is mandatory to keep technical documentation on the territory of Ukraine and provide it to market surveillance authorities upon request.

 

A conformity assessment procedure according to the module H (compliance based on the full quality assurance) includes assessment of the quality management system of a manufacturer by the responsible body.

 

After the national declaration of conformity is accepted by the manufacturer (or its local representative in Ukraine), the national conformity mark (UA TR mark) should be applied. The mark of compliance with technical regulations should be accompanied by the identification number from the responsible conformity assessment body if conformity assessment is carried out according to the module H.               

 

It is mandatory to keep technical documentation on the territory of Ukraine and provide it to market surveillance authorities upon request.

 

Conclusion:

 

Radio equipment that was distributed before April 1, 2018 must comply with the requirements of the Technical Regulations for radio equipment and telecommunication terminal equipment, Technical Regulations for electromagnetic compatibility of equipment, and Technical Regulations for low-voltage electrical equipment.

 

After April 1, 2019, radio electronic products distributed to the Ukrainian market are subject to mandatory compliance with the Technical Regulations for Radio Equipment. Conformity assessment is proved by the DECLARATION OF CONFORMITY. This declaration must be registered with the National Commission for the State Regulation of Communication and Informatisation (NCCIR). Only Ukrainian residents (or an authorized representative of a foreign manufacturer in Ukraine) can apply for the RED declaration.
