Peru Approves Regulation on 5G Deployment

The Ministry of Transport and Communications of Peru (MTC) published Decree No. 004-2025-MTC. The document approves the regulations for the promotion of the deployment of public telecommunications services using the fifth generation (5G) or higher technologies. The regulation improves the spectrum allocation approach, establishes investment requirements to get better control and utilization of the radio spectrum, as well as efficient spectrum use at the national level that brings benefit to all parties involved.

These requirements apply to both domestic and international companies interested in getting access to 5G spectrum. The applications asre subject to Compromisos Obligatorios de Inversión (COI), or mandatory capital commitment, which aim to expand the coverage in underserved areas, improve service quality, build additional 5G infrastructure, and address some technical of political objectives. 

Once the special assignment mechanism in a given frequency band is completed according to the requirements of the regulation, the MTC may use any remaining radio spectrum segments for private 5G or higher networks, subject to modification of the PNAF. The MTC may also identify additinal frequency bands eligible for network assignment.

The most preferable spectrum for 5G is 3300–3400 MHz and 3600–3800 MHz frequency range, which are to be restructured and deployed in harmonized segments to reduce interference and optimize performance.

The regulation also describes the procedures for getting access to the special allocation mechanism for interested companies along with legal requirements. 

Additionally, the MTC reserves the right to consider alternative tools to facilitate migration or infrastructure development and to approve the deployment of additional frequency bands for the use by future advanced technologies.
