The Ministry of Communications, Postal Services and Digital Economy of Niger issued Order No. 10/MCP/EN/SG/DL on the content and conditions for issuing approval certificates for radio equipment and installer approvals. This Order terminates two older ones:

1. Order No. 018/MPT/EN of December 31, 2015, which determined the conditions and procedures for approval and carrying out installer activities, as well as the provisions related to installer approval and certification.
2. Order No. 012/MC/C/DPT of March 10, 2005, which established the list and procedures for payment of fees under the authorization, declaration, network, and free service regimes.

The Order describes the approval principles for any terminal equipment imported or manufactured within the national territory and intended for sale on the Nigerien market, as well as any radio equipment — whether or not intended to be connected to an electronic communications network open to the public. 

The only exemptions include portable equipment used solely for the reception of audio broadcasting programs and equipment intended for national defense and public security purposes. 

Please note, the Regulatory Authority defines the standards applicable to the approval of terminal and radio equipment in accordance with international norms and standards. These applicable standards are updated annually and made available to the public by the Regulatory Authority.

Once the approval is granted, the regulatory body issues a type approval certificate with a validity period of three years. The Order also specifies the content of the certificate. 

The type approval certificate may be renewed upon the applicant's request, provided that the equipment continues to meet essential requirements. However, if the equipment has gone through modifications to its specifications and technical references or its country of origin, a new type approval application is required.

Additionally, the Order specifies requirements for installers in the field of electronic communications approval as well. The installer's license is valid for two years, is renewable, personal, and non-transferable.

Please note that there are penalties for selling unapproved terminal equipment as well as penalties and custodial sentences for improper installation of such equipment.
