European Union Adopts New Machinery Regulation

European Union Adopts New Machinery Regulation

The European Parliament and the Council of the EU adopted the new Machinery Regulation (EU) 2023/1230 in June 2023, which will replace Directive 2006/42/EC. It is currently in a transition phase until January 20, 2027. The Regulation will not affect already issued EC type examination certificates (Declaration of Conformity or Declaration of Incorporation) under Directive 2006/42/EC until they expire.

The scope of the Machinery Regulation is categorized and includes machinery and the following related products: 

  • interchangeable equipment
  • safety components
  • lifting accessories
  • chains, ropes, and webbing
  • removable mechanical transmission devices

It is specified that the Regulation also applies to partly completed machinery. Such clarifications allow for better understanding of the Regulation's provisions.

As of June 2025, the following provisions of the Machinery Regulation took effect, and key amendments were implemented:

  • Article 6(2) – (8), (11), 26 – 42, 47, 48, 50(1), 52 and 53(3)
  • Chapter VI of the new Regulation applies to products placed on the market under Directive 2006/42/EC, superseding Article 11 of that Directive
  • Corrigendum with regards to date modification
  • in Article 3 definitions of “crisis-relevant goods” and “internal market emergency mode” as well as Chapter IVa “Emergency procedures” were added according to the Regulation (EU) 2024/2748 

Please note, provisions of Regulation (EU) 2024/2748 related to Machinery Regulation will apply from May 29, 2026. Starting from July 20, 2025, and every five years thereafter, Member States shall conduct surveillance of every category of machinery or related products to perform hazard identification studies — this includes risks arising from intended use and reasonably foreseeable misuse due to safety defects, harm caused, known accidents and serious close calls. This and any other related information must be submitted to the Commission.
